Care Providers Haver A Duty To Keep Residents Safe

Cases of sexual assault are often the result of a failure to properly investigate the background of employees working with the residents. Other types of abuse occur when residents that have a history of abuse or neglect are placed with others putting them at risk. The care facilities have a duty to supervise the staff as well as protect the residents and ensure that they are in a safe and home like environment and free from any form of abuse and neglect.

The Minnesota Vulnerable Adults Act Minn. Stat. § 626.5772, Subd. 3 (c) defines sexual abuse to a vulnerable adult as “Any sexual contact or penetration as defined in section 609.341, between a facility staff person or a person providing services in the facility and a resident, patient, or client of that facility.”
